Amendment to the rule on admissibility of evidence in PBS appeals comes into effect on 23 May 2011

New section 85A of the Nationality Immigration and Asylum Act 2002 comes into effect on May 23, 2011. Its provision limits admissible evidence in Points Based Appeals to evidence that was submitted in support of, and at the time of making, the application to which the immigration decision is related, as far as the appeal is based on the ground that the decision is not in accordance with the immigration rules. The limitation does not apply to other grounds, such as incompatibility with the Human Rights legislation. It is permitted to adduce additional evidence proving validity or genuineness of a previously submitted document.
