NewsChanges to Tier 1 Guidance documents and new Tier 1 Entrepreneur form
UKBA has published revised policy Guidance documents in all Tier 1 categories. The revisions are of minor nature and do not purport to smuggle any legal changes to the Tier 1 routes.
The incorporation into the guidance document of clarified provisions as to the circumstances where UKBA will make requests for missing or incorrect documents is a welcome improvement on the previous lukewarm half promise that UKBA might contact the applicant for further documents.
The statement amounts to an obligation on the part of the UKBA and failure to act in accordance with this guidance document will create a potential for challenging the decision.
The new Tier 1 Entrepreneur guidance clarifies the duty of the Secretary of State to take into consideration any investments made when the applicant was in a different immigration category. Again, this does not amount to change of law, but clarifies the position of UKBA in this matter.
A new Tier 1 (Entrepreneur) form is published today. Applications on the old form will be valid until 5th March 2012.
