Services to Employers of Migrant Workers

We offer employers assistance with the legal side of employing migrant workers.  This includes sponsor licence applications, HR training, and general compliance with UKBA requirements for Tier 2 and Tier 5 sponsors.

We provide comprehensive immigration solutions to corporate clients wishing to engage staff from outside the European Union, or to relocate their existing staff from an overseas branch of the company to the UK. 

Any UK-based employer wishing to employ migrant workers from outside the EU has to have an Employer Sponsorship Licence. The licence will permit the employer to issue "certificates of sponsorship" which may be either pre-allocated ("unrestricted") or custom issued on the basis of the number of points scored with reference to the job position and salary ("restricted" certificates). Restricted certificates are limited to approximately 1200 a month.  Those whose score is sufficiently high to get them within the monthly allocation will get their certificates, those who did not succeed may apply the next month.

Tier 2 migrants extending their stay in the UK need an "unrestricted" certificate, whether they are extending their visa in order to continue working for the same employer or applying for a variation of visa when changing employer.

From April 2012, Tier 4 students will be able to switch to Tier 2 using "unrestricted" certificates, in other words, without the need to compete for a limited number of places.  Their salary has to be not less than £20,000 a year and in accordance with the Standard Occupational Code published by the UKBA.

Illegal employment of migrant workers is classed in the UK as a criminal offence. It bears penalty of up to £10,000 and may be punishable by imprisonment. We strongly recommend prospective employers to seek legal advice so as to ensure full compliance with UKBA requirements for sponsors.
